Police State Checkpoint Nullification in Upper Moreland, PA

The problem with these checkpoints is that they're warrantless, arbitrary searches. This goes against all standards of civilized behavior and is not tolerable in a free society.  Not only are checkpoints violating our rights they're not effective. "Traditional police patrols are three times more likely to locate genuinely impaired drivers than these suspicionless checkpoints," according to James Babb, founder of the Valley Forge Revolutionaries. "So not only are these checkpoints blatantly immoral and illegal, they're also a waste of police time and tax dollars. It's long past time someone took a stand for fiscal responsibility, the rule of law, and plain common sense."  That's exactly what happened on Friday night:

A note on staying out of trouble and keeping the activism going, don't talk to the police. Stay alert for the tricks they use to provoke a problem that they then use as an excuse to arrest or threaten to arrest activists for. I want to thank my fellow checkpoint nullifiers for having the discipline and level headedness that kept us all safe from the police.

  5. I was a professional commercial radio broadcaster until the fall of 1996 when I decided on a career change into commercial truck driving. It wasn't until I started driving an '18-wheel revenue generator' that finally I saw the beginning of tyranny amid individual rights violations and blatant disregard for our Bill of Rights; tyranny that wasn't visible inside broadcast studio. Twice I refused to voluntarily produce my logbook of record upon demand by a DOT officer and twice I was ticketed for non-compliance. The first time was at the scale in Nebraska City, Nebraska and the second time was on the westbound side of I-10 in Arizona going to California. On both occasions I specifically reserved my rights under my 4th Amendment right to privacy in my person, my PAPERS and my effects and as well my 5th Amendment right not to be compelled to be a witness against myself. By voluntary compliance with the DOT officers in question in handing over my logbook I would, in the eyes of the court, be waiving those rights by complying. The officers who cited me didn't want to hear about my reservation of rights and cited me for non-compliance. Anyone recieving a ticket for an infraction such as this cannot even speak about Constitutional rights in a court without incurring a 'contempt of court' charge by a sitting judge because an intital hearing is where the defendant is limited to only discussing the 'facts of the case' at hand. It's completely rigged in court and the only venue would be in a higher court after the citation was paid at a huge cost for litigant counsel arguing the Constitutional merits of any case and who can afford that? Certainly not a truck driver who would be required to be present in court. Tyranny raised its' ugly head here in Amerika long before the general public started seeing it firsthand after 9-11-2001.

  6. The other day I heard and saw a guy spraypainting grafitti outside my apratment a 1 AM. The next day I called the complex and told them about it. The lady said to me twice "well...did you call the police?"
    The fact that it had not even occurred to me to call the police made me realize, that deep down I don't trust the police. And I seriously doubt they would have caught the perp.

  7. Since the courts have ruled police officers are not obligated to protect (and therefore serve)- why call them anyway?
    They make money for the city they work for by ticketing speeders, stop sign runners, kids who don't show up for school.
    Their good at lying and crapping on the real law.
    I must say they are good at jailing drug related criminal acts- when they can catch them.

  9. Seems like people are getting fed up being treated like
    conquered Iraquis. If the cops want to catch drunk
    drivers, they should patrol in their cars. It's not like a
    drunk driver is hard to spot, but it takes a little more
    work, and the sober drivers get let alone. As it is with
    these checkpoints, everybody gets treated like a
    criminal. On the other hand, when are the drunks going
    to learn that you don't drive impaired. If caught, they should be prosecuted to the full extent of the law.

  14. If only we could get one of those magic pens that makes everything go.We could write new laws or better laws or whatever we want.Then we would be free and they couldn't abuse us anymore.I wait for that day to happen while eating popcorn.I want no part of this.

  16. You should also worry about the Nazi Grocery Gestapo at walmart. They stop you at the door just to demand a reciept to prove you arent stealing walmart blind. If society lets this continue, well, then god help us all.

    1. I just walk right past the Walmart gestapo. Had several of them tell me 'I have to check your receipt'. Tell them no you don't. Had one jump in front of me and attempt to stop me. Informed them that since I was still in the store, I could not have stolen anything and if he thought I had, he'd better be a deputized police officer prepared to make an arrest which cannot be done until I exit the store. He quickly moved and said have a nice day.
      Don't give in to them.

      Since then, they have quietly put up a small sign in an out of the way place that says all persons entering or leaving the premises are subject to search.

  17. The right to privacy is basic to maintaining all other rights. A govt that can stop & question anyone at will can stop them from opposing its polices. While there are many well intentioned people who support checkpoints they should reconsider their view. One can't advocate for the tools a dictatorship needs to oppress without considering all the implications. Liberty isn't safe where privacy is destroyed.

    It never occurred to me to just stand there say *nothing* when confronted by a cop.

    You can see the befuddlement on the cop's face. He desperately searches his mind for some way to generate a conflict which he could label a "threat". I love it.

    Whomever these protesters are, Kudos.

  20. Quite astute of you all to recognize that the cop was ATTEMPTING to walk into the sign in order to create an excuse for arrest. If you have any "pre-action" meetings (and I suspect you do) *show* that clip and teach everyone participating what to look out for. KUDOS, Freedom Fighters!

  21. Overall, I applaud this action... but I have a couple of reservations, which both boil down to a fear that these guys undermine their own cause in subtle ways.

    The first is a bit academic/pedantic. The comment that patrols are three times more likely to catch impaired drivers than checkpoints are doesn't necessarily mean what they imply it to mean. It may be that checkpoints are less effective at catching drunk drivers, but *more* effective at deterring drunk driving... which, after all, is the reason we have DUI laws. In fact, it's possible that checkpoints are less effective at catching impaired drivers *because* they're more effective at deterring impaired driving. I'm not saying that's the case; I don't have any data one way or another, but there are other reasonable interpretations of the statistics which favor checkpoints over patrols.

    It's never a good idea to build your platform around easily-discredited arguments.

    The second, and more serious, concern that I have was all of the talk about "saving" people at the end. It seemed pretty clear that they were talking about saving drunk drivers from apprehension, not about saving law-abiding citizens from illegal searches and harassment.

    I can't get behind saving drunk drivers. I'm willing to accept that letting some drunk drivers get away with it is a reasonable price to pay for letting law-abiding citizens go unmolested, but at the end of the video that did not seem to be the protesters' motivation. Perhaps it really was, but if so, their recorded comments do their intentions a disservice.

    1. Shawn, thanks for the thoughtful comment. I'm not sure why you think we wanted to save drunk drivers. Our signs aren't about that & our explanations are about people's right to privacy. We did save people from going through the indignity of the checkpoint. Let me present a bigger picture, the IRS can warrantlessly audit anyone at anytime. The TSA can suspicionlessly search everyone wanting to travel. The police stop & frisk whoever they want & most of their victims are in fear of physical harm if they don't go along. Inspectors of all kinds can just walk in to a business & search it. This is out of control. We need to establish the principle that the govt doesn't have the right to search us whenever it wants to. This is the road to dictatorship.

  22. 1)"Warrantess, arbitrary searches"? A stop is not a search, and no search proceeds without probable cause.
    2)"Not effective"? Of course they are...lots of people get caught drinking and driving. And many more are deterred.
    3)"Blatantly...illegal"? Not according to the Supreme Court (I suppose you agree with the new health care law, yes?)
    4) Waste of police time? Not at all, it's overtime.
    5)"Safe from police"? I'm sure they were all ready to beat you up. Please....

      A stop is a seizure according to the supreme court & yes there is a search when you're stopped. As to probable cause, the police have such wide discretion & are known to lie that even bringing up the idea is a joke.

      Patrolling is more effective than checkpoints. Plenty of studies show that. I'm not sure there's a deterrent effect since checkpoints are sprung on the drivers by surprise.

      Read the dissent in the Sitz decision. The supremes decided to ignore he constitution. The majority got it wrong, that's why it took until '90 to overturn previous courts that held checkpoints unconstitutional.

      I agree the overtime is great for the cops, but bad for the taxpayers

      They may not have wanted to beat us up but you can see in the video the cop's attempt to walk into my sign to create an incident. Maybe they only wanted to arrest us. Does that make it OK with you? We committed no crime.

    Police checkpoint activism – New Hampshire style

    A recent Manchester checkpoint was scheduled for 2 nights, back to back. The liberty activists were so successful at warning motorists about the police checkpoint that the police didn’t even do the checkpoint on the 2nd night. The July 20th checkpoint started on Elm St but after liberty activists effectively warmed many motorists, the police moved the checkpoint to Bridge St. The liberty activists continued to effectively warn motorists at the new location. The latest report available at Porc411 indicated that police may have given up and not even run a July 21st checkpoint.

    Update: I was told by 1 of the activists that as far as he knew, a checkpoint didn’t happen on July 21st. That’s likely because of the July 20th activism. Sometimes, standing up for your rights does work :)

    "Checkpoints are what dictatorships do," said Darren Wolfe, 53 of Royersford, who participated in a checkpoint protest in Montgomery County last year and videotaped police pulling over drivers who turned around. "When people have no privacy, the government can just stop you and ask you what you're doing and take a look at you for whatever whimsical reason they come up with," Wolfe said. "We do not live in a free society anymore."
